Cases We Handle
Our experience is deep and makes us the go-to firm in Washington County. We have helped clients with:
- Child custody disputes
- Paternity suits
- Child abuse or neglect cases
- Grandparent visitation
- Interstate support issues
Regardless of the case, our approach is the same. We carefully review the surrounding factual circumstances and vigorously promote our client’s interests.
New York’s domestic relations law provides the framework for protecting your rights during a family law dispute. Court opinions provide additional detail and carry the force of law, as well. Whatever your dispute, you can be sure that your family law attorney at the Colwell Law Group keeps abreast of the latest developments coming out of the courts.
Some of the more important laws are:
Domestic Relations Law § 170. This provides the grounds for divorce, including abandonment, adultery, and irretrievable breakdown of the marriage (no-fault).
Domestic Relations Law § 230 and 231. These provide information about whether you can ask a New York court to divorce you. You must be a resident of the state for a sufficient amount of time.
Domestic Relations Law § 70. The legislature states that child custody decisions should be based on the “best interests” of the child. Judges can consider anything relevant in this analysis, and court cases have broadened the factors to include things like:
- Each parent’s age
- Each parent’s physical, mental, and emotional health
- How much support each parent has provided the child in the past
- The stability of each parent’s home
- The child’s ties to community and family members
- Whether the child has siblings
At the Colwell Law Group, we not only go into court to fight for our clients, but we can also take a more collaborative approach if you prefer. In a collaborative divorce, for example, the couple commits to finding common ground and reducing conflict. Instead of going into court, you and your lawyer meet with your spouse (and his or her attorney) and collectively try to hammer out a divorce that works for everybody, including your children. Many clients have found the collaborative approach to be satisfying, as it allows couples to continue good relations for the sake of their children.
