Relevant Laws

The state’s domestic relations law provides the framework for protecting your rights during a family law dispute. Court opinions provide additional detail and carry the force of law, as well. Some of the more important laws are:

Domestic Relations Law § 170. This provides the grounds for divorce, including abandonment, adultery, and irretrievable breakdown of the marriage (no-fault).

Domestic Relations Law § 230 and 231. These provide information about whether you can ask a New York court to divorce you. You must be a resident of the state for a sufficient amount of time.

Domestic Relations Law § 70. The legislature states that child custody decisions should be based on the “best interests” of the child. Judges can consider anything relevant in this analysis, and court cases have broadened the factors to include things like:

  • Each parent’s age
  • Each parent’s physical, mental, and emotional health
  • How much support each parent has provided the child in the past
  • The stability of each parent’s home
  • The child’s ties to community and family members
  • Whether the child has siblings
