Filing a Petition for an Order of Protection in Warren County

One of the first things that you should do if you are a victim of domestic violence is to get yourself to a safe location. You should then start the process of filing a petition for an order of protection. An order of protection is a court-issued order that prohibits your abuser from making contact with you, coming near your home or place of work, carrying a firearm, and more. You may seek an order of protection against another person through the family courts in Warren County if:

  • You are related to the individual by marriage or blood;
  • You were or currently are married to the individual;
  • You are currently or were in an intimate relationship with the individual; or
  • You and the individual have a child together.

As a note, it is also possible to seek an order of protection through criminal court. Our lawyers assist clients interested in filing petitions for orders of protection with the family court.

What Does a Family Court Order of Protection Do?

When you file your order of protection with the court, you will need to include as many details about the abuse you have suffered in your petition. Further, you will also need to ask the court for anything specific that you want; while most orders of protection prohibit acts like harassment and assault, you may ask the court for other protections. You may ask the court to order the abusive party to stay away from you, pay you temporary child support, refrain from coming in contact with your children, and more. You can also ask the court for a five-year order of protection rather than the standard two-year in some cases.

As a note, upon filing your petition for an order of protection, you will be granted a temporary order before the other party is served with the order. This order will only remain in effect until you and the other party go to court for a hearing, and which case a longer order of protection will be put in place.
